I can try and assume. The club see value in the player and want to retain them, they haven't been approached by a team wanting to sign them and hence the conversation hasn't occurred or the Jets want rid but the player wants to stay, hence the termination isn't mutual (this word is probably missing from my original post).
Here is another rationale, we have not had the money for these payouts. Just because the payout isn't included in the cap does not mean that we have the cash to do this. Under FFA control we ran to a tight player budget which ruled out using any salary cap concessions. So paying out players obviously was not an option.
Ledman has opened the purse strings a little but we still run under a player budget. Yes we could pay out these players but what exactly would that achieve. Both Pav and Brennan would be min wage, so assuming we are spending up to the cap limit this year (addition of Hoole and Duncan would indicate that) could only be replaced by min wage players. Plus the payout itself eats into our player budget meaning less can be spent overall.
I would however like to see one or both of the remaining Visa players be signed as marquees, in name only, so that should players, such as Brennan, leave mid season on their own accord we have some flexibility under the cap.
Having looked at this and tried to find some information, I don't necessarily believe this is accurate. I remember the FFA brought some flexibility to the system, something like a contract termination payment (i.e. payout of a contract) could be spread out over the following 2 years or that it could be brought forward to the current salary cap year (i.e. next years salary included in this years etc). I could be wrong and happy to be corrected, but if it were the case then SFC would have cut half their contracted players this year (particularly Smeltz).

Find a club willing to take on someone not good enough for our squad AND willing to pay them similar cash, or more????
Find replacements who would improve the squad, and be willing to sign on similar wages to the lesser players we are moving on????
Pav and Brennan would know where they stand, and that they're on a good thing at the moment.
So too with BK, but not because of his ability, if his wage rumours are true it's simply because he's being paid overs. I think he'd get a gig elsewhere, but not on the money he's apparently on..... That and I reckon they see him as a legitimate starting option this season.
It's not poor management of the current administration. It's still a hangover from poor management decisions made previously.
