I'm seeking ethical advice. The reasonable and thoughtful views in this thread made me think this is the place to ask.

A 56-year-old lady drove her car into mine in a car park. My vehicle's nothing special: an eight-year-old hatch. No structural damage but about a square foot of scratches and paint taken off. Ditto for her car.

She was confused. I got the impression she was pretty poor. I suspect that paying the excess for my insurance would be tough for her. She'd been visiting a medical specialist.

If you were me, would you lodge a claim? My car's imperfect as it is; it has other scratches and dents.

are the damages worth more than the excess?

consider paying the excess for her

Just to clarify, she pays her own excess. Yours is what you pay to lodge a claim as far as I understand it. Hence premiums are lower the higher your own excess.

I think Boz means couscous will pay the lady's excess. Through no obligation, just goodwill. In the hope that the excess is say $500 and damages for his car are $500+ and then + her car.

Had a incident a few years back where I gave somebody a gentle nudge at the lights. No scratches, little mark that came off with some water upon inspection. She then contacted me trying to claim that I scratched the side of her rear (just above the rear wheel) to which I replied hell no. She then said that the rear bumper panel had been slightly dislodged (which I would believe). Long story short she tried to fleece me $700. my excess was $500. I told her to get 3 more quotes, and 2 places came back at $300, $350. So just paid it.
I'm still unsure whether I caused the rear panel displacement or if that was From the rear side panel incident. I suspect I was used as a means to get it fixed, oh well.

I mean, I'm as cold as they come with a lot of this shit but if circumstances are as you described I wouldn't be taking a cent of that ladies money.

Shrug your shoulders, walk away and hope someone does similar for you one day.

Few years ago I was watching a game of local football and upon returning to my car noticed a note on the windscreen saying someone had reversed into it. There was mostly just cosmetic damages. I took the car to the smash repairers local to me and they said it'd cost $250 to fix. I rang the person who left the note and they were more than happy, and willing, to pay it for me. Easy done. Faith in humanity restored. No insurance needed.

Have you sussed out the amount it'd cost to fix your car? That's probably the major thing to do - find out how hectic cost-wise it'd run either of you guys or your insurance.
    OK

Doubt it. If I got a quick paint job, it'd be $200 or $300, I think. My excess doesn't matter as it was her fault, but her excess is probably $500 to $750 or thereabouts.

I agree with this. Unfortunately, my wife didn't. She told me to get insurance to sort it.

Good news is my whole front bar (chassis section) will now be replaced, which will fix some scratches and dents from other incidents. Bad news is that the old biddy will cop the excess, and her premium might suffer, too.

I definitely lost some soul points; I'll need to pay an indulgence fee to the local branch of the Catholic Church Pty Ltd.

Mike Baird - what will this sack of shit root around with next?

For a liberal he sure likes introducing plenty of new regulations.

Might be an idea if he runs at the next election as a Commie.
